Terms and conditions of use

The conditions governing access to and use of Study Salad. By signing up and using the platform you declare that you have read and accepted them.

1. Scope

1.1 Scope of the service

Study Salad is a digital platform developed and managed by Digitup Studio S.L. whose purpose is to provide primary and secondary (ESO) students with tools based on artificial intelligence (AI) to organize, practice and review their studying: a study planner, quizzes, flashcards, summaries, outlines, mind maps, formative feedback and an AI tutor, among others.

1.2 Subject of the contract

This contract governs the conditions of access to and use of the Study Salad platform (hereinafter, the "Platform") and of all the services, content and features it makes available to the user (hereinafter, the "User"), whether free of charge or through a subscription. By signing up and using the Platform, the User —or their legal guardian in the case of minors— declares that they have fully read, understood and accepted these Terms.

1.3 Changes to the terms

Digitup Studio S.L. reserves the right to modify, update or remove, at any time, all or part of these Terms, as well as the features offered. Minor changes may be notified by publication on the Platform or by email. When the modifications are substantial (especially if they affect data processing, the provision of the service or the financial conditions), the User's express acceptance will be requested. Continued use after notification will imply agreement with the new terms.

2. Registration and use

2.1 Use of the Platform

The Platform allows registered users to access AI tools to study, review and organize their learning for educational purposes. The User undertakes to use it in an ethical and lawful manner and in accordance with the purpose for which it was designed. Under no circumstances may it be used for unlawful or fraudulent acts or acts that infringe the rights of third parties. Digitup Studio S.L. may limit, suspend or cancel access if it detects improper use.

2.2 Registration and minors' accounts

Creating an account is required to access the services. As Study Salad is aimed at minors, the account must be created or authorized by a parent or legal guardian, who acts as the responsible party and gives consent for the processing of the minor's data in accordance with the privacy policy. The User undertakes to provide truthful, up-to-date and complete information. Digitup Studio S.L. may reject, suspend or cancel any registration it considers fraudulent or contrary to these Terms.

2.3 Licence of use

Upon registration, the User acquires a limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to access and use the Platform solely for lawful educational and personal purposes. The following are expressly prohibited:

  • Reproducing, copying, distributing or commercially exploiting the services or content, except with express authorization.
  • Automating access through bots, scripts, scraping or data mining.
  • Using the Platform to develop a similar or competing product or service.
  • Sharing access with third parties or reselling the service.

2.4 User responsibilities

  • Keeping their access credentials confidential.
  • Ensuring that the information provided is truthful and up to date.
  • Using the Platform ethically and in accordance with applicable law.
  • Immediately reporting any unauthorized access or security incident.
  • Refraining from uploading or generating content that infringes third-party rights or is unlawful, offensive or inappropriate.

3. Artificial intelligence tools

3.1 Interaction with the AI

Through Study Salad, the student interacts with artificial intelligence systems that help them study: they generate quizzes and flashcards from their syllabus, summarize content, create outlines or mind maps, correct answers and guide questions. Study Salad's pedagogical approach is clear: the AI guides and trains the student, it does not do the work for them.

3.2 Use of third-party technologies

Study Salad integrates AI models developed by third parties (such as OpenAI, Google Gemini, Anthropic, Mistral, DeepSeek or others that may be incorporated). The User acknowledges and accepts that:

  • The generated responses are the product of probabilistic algorithmic processes and may contain errors or omissions.
  • Study Salad does not guarantee the truthfulness, accuracy or suitability of the generated content.
  • Digitup Studio S.L. acts as an integrator and facilitator of these technologies.

The generated content is a study aid and does not replace the student's learning or the teacher's judgment. It is the User's responsibility to review the content before using it.

3.3 Trial phase

Study Salad may offer a free or promotional trial phase to explore the features before taking out a subscription. Its existence and duration are determined at our discretion and may vary depending on promotions or the User's profile. Access to this phase does not grant a right to a permanent service or to a refund.

4. Subscriptions, billing and cancellation

4.1 Subscription plans

Study Salad offers access to its premium features through a subscription with automatic renewal. The current plans, prices and features are shown on the Platform at the time of purchase. Purchasing a plan gives immediate access to the included features during the relevant period. Digitup Studio S.L. reserves the right to modify prices and conditions, giving reasonable prior notice.

4.2 Billing and payment methods

The subscription is billed automatically at the start of each cycle through secure payment providers (Stripe and PayPal). Amounts may be subject to currency conversions or fees depending on the country and payment method. You can request invoices by writing to legal@studysalad.es.

4.3 Cancellation

The User may cancel their subscription at any time from their account, without needing to justify it. Cancellation prevents the renewal of the next cycle; premium access is maintained until the end of the period already paid for. No refunds are made for unused periods once the cycle has begun, so we recommend cancelling in advance of the renewal.

4.4 Refunds

Refund requests are assessed on a case-by-case basis, at the discretion of Digitup Studio S.L. They may be considered in exceptional situations such as duplicate charges, technical failures that have prevented access, or billing errors attributable to the Platform. Refunds are not granted for voluntary cancellation after using the service, dissatisfaction with the generated content, breach of the Terms or a change of mind. To start a request, write to legal@studysalad.es with your name, the account email, proof of payment and the reason.

5. Disclaimers and warranties

Study Salad is offered "as is" and "as available", without warranties of any kind. Although Digitup Studio S.L. strives to offer a functional, stable and secure platform, it does not guarantee the complete absence of errors, interruptions or technical failures, nor that the generated content is complete, accurate or truthful. AI responses are based on statistical models and do not constitute professional advice. The use of the generated information is the User's responsibility. Digitup Studio S.L. shall not be liable for indirect, incidental or consequential damages arising from the use of or inability to use the Platform, except where required by applicable law.

6. Data protection

The processing of the User's personal data is governed by Study Salad's Privacy Policy, which is an integral part of these Terms. It details what data is collected, for what purpose, how it is stored and protected, what rights the User has and how to exercise them. Accepting these Terms implies acceptance of that policy.

7. External services

To ensure the operation and functionality of the Platform, Digitup Studio S.L. integrates third-party services selected for their reliability and security: Firebase (Google Cloud) for hosting and authentication; Stripe and PayPal for payments; OpenAI, Google Gemini, Anthropic, Mistral, DeepSeek or others for AI content generation; Mailgun for emails; and analytics tools. Digitup Studio S.L. shall not be liable for failures attributable exclusively to the internal operation of these services, and reserves the right to modify or replace them while maintaining the essential quality of the service.

8. Intellectual property

All the content, design, code, features, algorithms, trademarks, logos and other elements of the Platform are the exclusive property of Digitup Studio S.L. or of third parties with which it has licence agreements, and are protected by intellectual and industrial property legislation. The licence granted to the User is limited and does not imply any transfer of rights. Digitup Studio S.L. does not claim ownership of the notes or materials the student uploads, but reserves the right to block or remove content that infringes these Terms, third-party rights or the law.

9. Final provisions

9.1 Termination of the service

Digitup Studio S.L. may suspend or cancel a User's access in the event of a breach of these Terms, fraudulent use or behaviour that affects the security of the Platform. The User may request the voluntary deletion of their account and data at any time in accordance with the privacy policy.

9.2 Governing law and jurisdiction

These Terms are governed by Spanish law. For the resolution of disputes, the parties submit to the Courts and Tribunals of Madrid, unless consumer protection regulations provide otherwise.

9.3 Severability

If any provision is declared null or unenforceable, it will be deemed excluded without affecting the validity of the rest of the contract.

By accessing and using Study Salad, the User declares that they have fully read, understood and accepted these Terms and Conditions, constituting a binding agreement with Digitup Studio S.L.
